Introduction

CCL Property operates as a commercial and residential estate agent. These Terms of Business outline the basis on which we provide our services, form the agreement between you and CCL Real Estate Ltd t/a CCL Property (“CCL Property”), and apply to all engagements unless otherwise agreed in writing.

Fee Structure

Unless expressly varied, the following charges apply:

Residential Sale:

  • £350 marketing fee (payable on instruction)
  • 1% sales commission of the sale price.

Commercial Sale:

  • £1,500 marketing fee (payable on instruction)
  • 2.5% sales commission of the sale price.

Commercial Letting:

  • 15% of annual rent agreed (payable upon completion of tenancy)

All fees are subject to VAT at the prevailing rate unless otherwise confirmed.

Payment Terms

  • Marketing fees are non-refundable and payable on signing the agency agreement.
  • Commission on sale or letting is payable on completion, regardless of source of purchaser or tenant.
  • Payment of invoices is due within 7 days of issue. Overdue sums accrue interest at 8% per annum.

Agency Duration & Termination

  • Engagement typically begins on instruction and lasts for an initial period (normally 8–12 months), continuing until terminated by written notice.
  • Clients may terminate after the initial period by providing 60 days’ notice (commercial) or 4 weeks (residential).
  • Either party may terminate with immediate notice in writing; an early termination fee may apply.
  • A cooling-off period of up to 14 days applies to residential instructions, enabling cancellation without penalty.

Client Responsibilities

  • Clients must provide accurate information, access for viewings, and required documentation.
  • All offers on properties must be notified to CCL Property; if received directly or by solicitor, copies are to be provided within timeframes in your agreement.
  • Sellers and landlords are responsible for legal compliance (EPCs, safety certificates, home reports, statutory consents).

Advertising and Additional Services

  • Extra services (newspaper ads, premium listings, certificates, boards) are charged separately as agreed.

Data Protection

  • By using our services, clients consent to CCL Property processing their personal data for the purposes of fulfilling contractual and legal obligations.

Governing Law

  • These Terms of Business are governed and construed in accordance with the Law of Scotland, and the parties consent to the non-exclusive jurisdiction of Elgin Sheriff Court. ​

Registration for Preservation and Execution

  • The Parties consent to registration hereof and of any related contract, agreement, or missive for preservation and execution.

Entire Agreement

  • No other conditions or terms shall apply unless agreed in writing by CCL Property. These Terms of Business represent the whole agreement between the parties.
